THE ANTOP Hill police station on Saturday filed an FIR against its former senior police inspector Nasir Ahmed Kulkarni and a few other police personnel for allegedly beating up two lawyers inside the police station premises in May.
The complainant in the case, Sadhna Omprakash Yadav, 30, a lawyer, had given an application to the Deputy Commissioner of Police, Zone 4 on May 20, seeking an FIR against Kulkarni and other police personnel for assaulting her and her colleague inside the police station on May 18. As the police did not promptly register an offence, Yadav approached Bombay High Court and filed a writ petition.
The high court, during the hearing on June 22, directed Assistant Commissioner of Police, Matunga division to probe Yadav’s May 20 complaint and submit a report by July 3.
As per court’s order, ACP Matunga division carried out a preliminary inquiry and submitted a report to DCP, Zone 4, recommending that an FIR be registered against Kulkarni and 8-10 others including some police personnel.
Based on the finding of this report, DCP, Zone 4 directed Antop Hill police station to lodge an FIR against Kulkarni and others. The police on Saturday night booked Kulkarni and others under sections 324 (voluntarily causing hurt by dangerous weapons or means), 323 (punishment for voluntarily causing hurt), 504 (intentional insult with intent to provoke breach of the peace) and 506 (criminal intimidation) of the Indian Penal Code.
Mumbai police is already carrying out a departmental inquiry against Kulkarni, who was transferred to the city traffic department after this controversy.
Reacting on the development, Yadav said, “The police have filed a weak case and have not invoked sections of molestation and causing serious hurt, despite knowing the fact that I am suffering from Tuberculosis. During ACP S Jagtap’s inquiry, I had also identified seven women police personnel who were involved in assaulting me, but the FIR mentioned only Kulkarni’s name.”
The incident
The alleged assault took place on May 18 evening. According to Yadav and her colleague and lawyer Harikesh Sharma, they have an office at Wadala (east) and there were two persons in the locality who would close the door after she (Yadav) would go to the common washroom. They would then knock on the door from outside. As she was tired of the mischief, she initially contacted the administrator of the locality but as he refused to help, Yadav then dialled the Mumbai police control room and lodged a complaint.
Following her complaint to the control room, a team from Antop Hill police station went to the spot after which Yadav and the two alleged miscreants were taken to the police station.
Sharma, who was on the spot at the time, also went to the police station separately. “We tried explaining our grievances to them but the Station House Officer was not ready to lodge a complaint,” Sharma had said, adding, “We were then taken inside the cabin of senior police inspector Nasir Kulkarni after which there was some argument there and subsequently some women constables pulled Yadav outside the cabin and dragged her inside a neighbouring room where she was brutally assaulted.”
Sharma was also taken to another room, where he was allegedly beaten up by the policemen.
Ravi Jadhav, president of All India Federation of Advocates and Associations, had earlier said, “Senior police inspector Kulkarni has also assaulted them. Belt was used to assault both of them and Yadav had to be admitted to Sion hospital as her leg fractured in the assault.”
