Karnataka High Court orders college to pay Rs 10 lakh each to 10 nursing students for year loss

The Karnataka High Court has ordered Mother Mary College of Nursing in Kalaburagi to pay Rs 1 crore as compensation to 10 students who lost a year after the institution allegedly fabricated the register of admission.

The court emphasised that the college must financially compensate the students, even though it may not fully alleviate their suffering. As per the court’s directive, the college is required to pay Rs 10 lakh to each of the 10 affected students.

Justice Suraj Govindaraj issued the order while instructing the Rajiv Gandhi University of Health Sciences (RGUHS) to take action against the college, including filing a criminal complaint and initiating administrative measures.

The court observed that the college had not admitted the students prior to April 7, 2022, but created a fabricated admission register. It had pasted a sheet of paper with the names of the students, falsely claiming they had been admitted on time but their details could not be uploaded due to technical issues.

“The college played with the lives of the students and their parents who had aspirations for their wards to study BSc Nursing at the college. Due to the serious misconduct and negligence on the part of the college, the data was not uploaded since the admission was conducted after the deadline, without possibly informing the students, and fees were collected from them to insert their names in the admission register. This has resulted in a situation where, due to the RGUHS’s refusal, they would be unable to take the examinations for this year,” stated the court.

The college had approached the court seeking directions for the Medical Education Department to consider their representation, allowing them to upload the students’ details on the web portal and issue registration numbers for the first-year BSc Nursing Course examinations.

The college said it had admitted the 10 students for the academic year 2021-22, but due to glitches on the portal, their details could not be uploaded. The college claimed in its petition it had written to RGUHS in January 2023, requesting the portal to be opened for online submission of applications, but there was no response or action on the part of RGUHS.
