The Ahmedabad city police on Thursday informed the Gujarat High Court that it will need 12 weeks to upload the texts of 84 rules, regulations, instruction manuals and records pertaining to public assembly and other norms in the city on its website.
The submission was made before the division bench of Justice A S Supehia and Justice M R Mengdey, which was hearing a contempt petition filed by Ahmedabad resident Swati Goswami against city Police Commissioner Prem Vir Singh for “wilful and deliberate disobedience” of a HC order dated January 17.
The bench granted 16 weeks to upload the rules “in order to test the bonafide” of the authorities, posting the matter next for November 29.
The HC had in January held that the special police branch cannot claim exemption from disclosure of rules. It had directed the Ahmedabad Police commissioner to publish on the police website all the rules and orders framed under Section 33 (1) (o) of the Gujarat Police Act, which pertains to regulating the conduct of and behaviour or action of persons constituting assemblies and processions on or along the streets.
The order had further directed the Ahmedabad city police to comply with requirements of Section 4 of the Right To Information Act and publish and make available on its website the texts of all rules, regulations, instructions, manuals and records held by it or under its control.
The police, while listing the Acts and regulations applicable on its website, have not uploaded the texts of such legislations and regulations so far.
Earlier, the police had submitted that it is unable to find the rules under which it processes and rejects applications for protests in the city.
