The site engineer and contractor who were carrying out excavation work for a builder were arrested on Thursday on charges of negligence after the work allegedly led to a major cave-in of the road near Magathane Metro station on Wednesday.
Personnel of Kasturba Marg police station, who booked the duo on a complaint by the Brihanmumbai Municipal Corporation (BMC), however, refused to divulge the names of the arrested engineer and contractor. They were released on bail later.
“Based on the FIR lodged by the BMC, the two accused were charged under Indian Penal Code sections 34 (acts done by several persons in furtherance of common intention) and 336 (endanger human life due to act of negligence),” said senior inspector Anil Avhad of Kasturba Marg police station.
The accused were produced in a court in Borivali where they were granted bail, the inspector added.
According to officials of the Maha Mumbai Metro Operation Corporation Limited, the chamber of the storm water drain near the station’s Entry/Exit 2 is in close proximity to the foundation of the stairs and the escalator.
Because of the deep excavation carried out by the builder near the drain chamber, its wall was damaged. This led to storm water flowing into the excavation area, posing a potential risk of further collapse to the drain chamber and the foundation of the stairs and the escalator, officials said.
The repair works are going on even as the lift and staircase to the Metro have been closed for pedestrians for safety purpose.
